I'm not a lawyer, but it looks like the BATFE may be most interested in the notion of shooting a "pistol" with one hand vs. two. While the Magpul product is an Angled Fore Grip, and not technically "vertical", as a grip it is designed to provide the capability of shooting the pistol (in this case) with two hands. I know certain states dont allow "shrouds" on barrels so you can grab it with your left hand. However where does the line draw between handguard and shroud? Looking at the AR pistol, the handguard rail system seems to be all part of the upper.
This is borderline gray area and I suppose if someone wanted to be a dick about it they could.

State laws, as you know, are a whole other level of fun on their own. We're just chatting about Federal stuff at the moment... and the consequences for getting it wrong are severe.

Looks like you are in luck! Turns out somebody asked the BATFE specifically about the Magpul AFG... and it is not considered a forward vertical pistol grip. (Good call on that by Solscud007 too!)
